2. INFORMATION ABOUT YOUR PERSONAL DATA

2.2. Legal Basis for the Collection of Personal Data

First and foremost, the principles for the protection of personal data are established by the Constitution of the Republic of Turkey and the Law No. 6698 (PDP Law). In addition, the Law No. 6563 on the Regulation of Electronic Commerce also contains provisions regarding the protection of personal data. The Law No. 5237, the Turkish Penal Code, foresees criminal sanctions to be applied in certain cases to ensure the protection of personal data. On the other hand, the collection and use of data is necessary for the fulfillment of our obligations arising from the Law No. 6502 on the Protection of the Consumer / the Turkish Commercial Code and the Regulation on Distance Contracts.

2.3 Methods of Collecting Personal Data

Your personal data may be processed by Woodcoder during the online sale of Woodcoder products to you through the Site and during the creation of your Site membership, for the fulfillment of legal obligations within the scope of PDP Law Article 5/2, for the establishment and performance of the distance sales agreement between you and Woodcoder, or for Woodcoder's legitimate interests.

Your personal data processed during your visit to the Site may be processed for the purposes of enabling you to benefit from the services offered on the Site, following up on your opinions and suggestions conveyed to us through the Site and your questions and answers regarding our products/services and making the necessary directions, system management, identifying problems and developing the Site, sending you important updates regarding changes to the Site and its terms, protecting the rights and interests of you and Woodcoder, and responding to the requests of official authorities or communication matters.

In addition, in the event that you create a Site membership and purchase Woodcoder products, your personal data processed limited to the establishment and performance of the distance sales agreement is processed for the purposes of: (i) the sale of Woodcoder products, the issuance of invoices and the delivery of products to you or your affiliated institution, (ii) carrying out after-sales support service processes within the scope of the relevant legislation, (iii) evaluating and resolving questions, requests, opinions and complaints regarding our products or services and providing you with feedback, (iv) getting back to you based on your requests regarding our products and preparing product waiting lists, (v) planning and executing the processes of creating and increasing loyalty to the products and services offered by Woodcoder, and (vi) protecting the rights, security, property and operations of Woodcoder, you, your affiliated institution or third parties, and using the right of defense where necessary, or (vii) where there is an obligation to respond to the requests of official authorities or communication matters.

2.5 Protection of Your Data

All personal data you have shared is under the supervision and control of Woodcoder, which has the title of 'Data Controller' within the scope of the Law No. 6698 (PDP Law). In accordance with the provisions of the relevant legislation in force, Woodcoder has undertaken the responsibility, in its capacity as 'Data Controller', to establish the necessary organization and to take and adapt technical measures for the purpose of protecting the confidentiality and integrity of the information. Being aware of our obligation in this regard, we would like to inform you that we always update our data processing policies in accordance with international and national technical standards concerning data privacy.

Although we make the utmost effort to protect your personal data when you send it, it cannot be guaranteed that any data transmission over the internet or any public network is 100% secure.

In the event that links to other applications are provided through the Site, Woodcoder does not accept any responsibility for the privacy policies and content of those applications.

2.6 Sharing Your Personal Data with Third Parties and Transfer Abroad

The sharing of your personal data with third parties takes place within the framework of the permission you have given, and as a rule, personal data is not shared with third parties without our customer's consent. However, due to and limited to our legal obligations, your personal data may be shared with courts and other public institutions. In addition, in order to provide the services we have committed to and to carry out quality control of the services provided, personal data is transferred to the third parties with whom we have agreements. The necessary technical and legal measures are taken to prevent rights violations during the transfer of data to third parties. However, Woodcoder is not responsible for violations arising from the data protection policies of the third party receiving the personal data and occurring under the responsibility of the third party.

Your personal data may be transferred by Woodcoder, within the purposes mentioned in this Personal Data Protection Privacy Notice and limited to these purposes - primarily so that users can benefit from the Site and the activities carried out on the Site, and to ensure the data security of the Site - to (i) third parties located domestically and abroad from whom we receive storage, archiving, and information technology support (such as server, hosting, program, cloud computing, website content managers), (ii) our subcontractors and service providers acting on behalf of Woodcoder within the framework of our services, (iii) the group companies from which services are received, (iv) business partners, supplier firms, and consultancy firms from which support is received in fields such as legal, etc., (v) authorized institutions and organizations to fulfill legal or regulatory obligations or requests and other related parties to whom transfer is necessary for the specified purposes, (vi) relevant third parties in a possible merger/acquisition/restructuring process, only to the extent relevant to the process.

2.7 Duration of Data Processing

The personal data you have shared with Woodcoder through the channels mentioned in this Personal Data Protection Privacy Notice will, in accordance with the legislation on the protection of personal data - primarily the PDP Law - and the periods mandated in other legislation, in any case be processed as long as the processing purposes set out in this Personal Data Protection Privacy Notice do not disappear.

2.8 Your Rights

Pursuant to Article 11 of the PDP Law, you have the right to:

- Learn whether or not your personal data is being processed,

- Request information if your personal data has been processed,

- Withdraw any consent you have previously given us regarding the use of your personal data,

- Learn the purpose of the processing of your personal data and whether it is used in accordance with its purpose,

- Know the third parties to whom your personal data is transferred domestically or abroad,

- Request the correction of your personal data in the event that it has been processed incompletely/incorrectly,

- Request the deletion or destruction of your personal data to be evaluated within the principles of purpose, duration and legitimacy,

- Request that, in the event of the correction, deletion or destruction of personal data within the framework of the conditions foreseen in Article 7 of the PDP Law, these operations be notified to the third parties to whom the personal data has been transferred,

- Object to a result that arises against you in the event that the processed data is analyzed exclusively through automated systems,

- Request compensation for the damage in the event that you suffer damage due to the processing of your personal data contrary to the PDP Law.

In this context, you can submit your requests regarding the aforementioned rights to Woodcoder by filling out the application form on the Site together with information and documents establishing your identity, or by creating your own request in a manner that meets the conditions determined by the Personal Data Protection Authority.

Please confirm the current application methods and application content requirements from the legislation beforehand. Applications submitted in a manner and by methods that do not comply with the content requirements set out in the Communique on the Procedures and Principles of Application to the Data Controller will not be accepted.

Woodcoder will conclude your request free of charge as soon as possible and within 30 (thirty) days at the latest, depending on its nature. In the event that a cost arises due to the fulfillment of your requests, we can only charge you the fees in the tariff determined by the Personal Data Protection Board.
